Regulamin konkursu „To lubię w Szczecinie… wstaw trzy swoje zdjęcia ze sztuką w mieście, która podoba Ci się najbardziej”
Postanowienia ogólne
- Organizatorem konkursu „To lubię w Szczecinie…wstaw trzy swoje zdjęcia ze sztuką w mieście, która podoba Ci się najbardziej” zwanego dalej „Konkursem” jest galeria online SalonSztuki.net Jolanta Gramczyńska zwana w dalszej treści niniejszego Regulaminu „Organizatorem”.
- Przedmiotem konkursu są fotografie wykonane na terenie Gminy Miasta Szczecin przedstawiające miejsca, przedmioty z cechami sztuki, tj. mające wartość estetyczną, które Uczestnik uzna za szczególnie ciekawe i charakterystyczne dla tego miasta
- Konkurs przeprowadzany jest na podstawie niniejszego regulaminu.
- Konkurs rozpoczyna się 1 sierpnia 2020 r. i trwa do 30 września 2020 r.
- Udział w konkursie jest bezpłatny i dobrowolny.
- Organizator zastrzega sobie prawo do zmiany postanowień niniejszego Regulaminu w przypadku zmiany obowiązujących przepisów prawnych lub z innej przyczyny dotyczącej kwestii harmonogramu Konkursu.
- Konkurs jest organizowany na terytorium Rzeczypospolitej Polskiej.
Uczestnicy Konkursu
- Uczestnikami Konkursu mogą być wyłącznie osoby pełnoletnie (z wyłączeniem profesjonalistów i osób zawodowo zajmujących się fotografią), które we wskazanym powyżej terminie, na profilu sztukawszczecinie.pl na portalu społecznościowym Facebook w specjalnie do tego stworzonym wpisie zamieszczą fotografie przedstawiające miejsce na terenie Gminy Miasto Szczecin, które Uczestnik szczególnie lubi o charakterystyce spełniającej wymogi Konkursu.
- Uczestnikami Konkursu nie mogą być pracownicy ani osoby pozostające w stosunku zlecenia lub w innym stosunku prawnym, do którego stosuje się przepisy o zleceniu z Organizatorem Konkursu.
- Administratorem danych osobowych uczestników Konkursu jest Organizator. Dane osobowe przekazane Organizatorowi przez uczestników Konkursu będą przetwarzane w celu realizacji Konkursu. Dane osobowe mogą być także przetwarzane, gdy jest to niezbędne dla wypełnienia prawnie usprawiedliwionych celów administratora danych. Podanie danych osobowych jest dobrowolne, jednak ich niepodanie uniemożliwi laureatom otrzymanie nagród.
Zasady udziału w Konkursie
- Do Konkursu można zgłaszać jedynie fotografie wykonane samodzielnie, nigdzie wcześniej niepublikowane, których autorem jest Uczestnik. Wyklucza się prace tworzone wspólnie (współautorstwo).
- Każdy uczestnik może zgłosić maksymalnie 3 fotografie.
- Warunkiem udziału w konkursie jest polubienie profilu www.sztukawszczecinie.pl na portalu społecznościowym Facebook.
- Fotografie należy nadesłać w formie elektronicznej przez ich zamieszczenie (wklejenie) w formie komentarza w stworzonym specjalnie na potrzeby konkursu wpisie na profilu sztukawszczecinie.pl na portalu społecznościowym Facebook.
- Fotografie należy przesyłać w terminie od 1 sierpnia 2020 r. do 30 września 2020. Fotografie przesłane poza wskazanym terminem nie zostaną dopuszczone do udziału Konkursie.
- Nadesłane fotografie należy opisać według następującego wzoru: Imię_Nazwisko_Tytuł- zdjęcia oraz krótkie (do trzech zdań) uzasadnienie wyboru.
- Organizator dopuszcza dowolny format i wielkość przesłanych fotografii z zastrzeżeniem, że w przypadku słabej jakości fotografii lub niemożności odczytania formatu w jakim zapisana jest fotografia, nie weźmie ona udziału w Konkursie.
- Nie zezwala się na stosowanie fotomontaży, polegających na łączeniu elementów zdjęcia pochodzących z różnych plików.
- Przesłane fotografie będą mogły być komentowane i oceniane przez użytkowników portalu Facebook.
- Organizator zastrzega sobie prawo do dyskwalifikowania prac niespełniających wymienionych wyżej wymogów.
- Jeżeli na fotografiach konkursowych znajduje się wizerunek osoby, uczestnik przesyłając fotografię zobowiązany jest do dołączenia pisemnego oświadczenia osoby znajdującej się na fotografii, że wyraziła zgodę na nieodpłatną publikację i rozpowszechnianie wizerunku tej osoby.
- Każdy uczestnik Konkursu przesyłając fotografię zgodnie z treścią ust. 5 wyżej, udziela niewyłącznej, nieodpłatnej licencji do korzystania z fotografii na polach eksploatacji wymienionych w art. 50 ustawy z 4 lutego 1994 r. o prawie autorskim i prawach pokrewnych dla celów przeprowadzenia i rozstrzygnięcia Konkursu oraz w zakresie wynikającym z treści niniejszego regulaminu.
Jury
- Organizator powołuje trzyosobowe Jury Konkursu, zwane w regulaminie dalej „Jury”.
- Wszystkie zdęcia nadesłane do Konkursu podlegają ocenie Jury.
- Decyzje podjęte przez Jury są ostateczne i prawnie wiążące dla wszystkich uczestników Konkursu.
Nagrody
- Organizator przewidział następujące nagrody przyznawane przez Jury:
- nagroda główna dla zwycięzcy Konkursu: rejs promem Unity Line „Polonia” na trasie Świnoujście–Ystad i z powrotem, dla dwóch osób,
- 5 wyróżnień I stopnia: czarno-biały fotogram (60 cm x 80 cm) przedstawiający jeden ze szczecińskich statków PŻM-u autorstwa Marka Czasnojcia.
- 10 wyróżnień II stopnia: najnowszy album Marka Czasnojćia „Szczecin metamorfozy” z 2020 r. przedstawiający 75 lat historię polskiego Szczecina.
- Organizator przewidział także nagrodę „publiczności” która jest przyznawana wyłącznie na podstawie zgromadzonej liczby polubień (tzw. „lajków”) na profilu sztukawszczecinie.pl na portalu społecznościowym Facebook: najnowszy album Marka Czasnojćia „Szczecin metamorfozy” z 2020 r. przedstawiający 75 lat historię polskiego Szczecina oraz jego autorstwa czarno-biały fotogram (60 cm x 80 cm) przedstawiający szczecińskie statki PŻM-u.
- Nagrody w konkursie nie podlegają wymianie na gotówkę.
- Jury zastrzega sobie prawo do innego podziału nagród, a także do nieprzyznania nagrody w danej kategorii, jak również do dodatkowego nagrodzenia Uczestników Konkursu.
- Organizator konkursu zastrzega sobie prawo do opublikowania imion i nazwisk laureatów konkursu oraz umieszczanie tych informacji w materiałach reklamowych organizatora oraz w prasie, mediach i internecie.
- Zwycięzcy Konkursu zostaną powiadomieni o sposobie odbioru nagrody pocztą elektroniczną do dnia 24 października 2020r.
- Po przeprowadzonym konkursie zwycięzcy zobowiązani są do podpisana protokołu o otrzymaniu nagrody rzeczowej. Nagrody nieodebrane do 30 października 2020 r. przepadają i przechodzą na własność Organizatora.
Postanowienia końcowe
- Regulamin niniejszego Konkursu dostępny jest w siedzibie Organizatora oraz na stronie internetowej: sztukawszczecinie.pl.
- Uczestnik Konkursu przez wysłanie fotografii oświadcza, że: a) jest autorem załączonych fotografii; b) przysługują mu wyłączne i nieograniczone prawa autorskie do nadesłanych fotografii, które to jako utwory fotograficzne pozbawione są jakichkolwiek wad prawnych i nie są obciążone prawami i roszczeniami osób trzecich; c) zgadza się na opublikowanie zdjęć na stronie www.sztukawszczecinie.pl oraz w serwisie społecznościowym Facebook na profilu sztukawszczecinie.pl w czasie trwania konkursu oraz po jego zakończeniu.
- Osoby, które nie spełnią któregokolwiek z wymogów określonych w niniejszym Regulaminie lub podadzą nieprawdziwe informacje, zostaną automatycznie zdyskwalifikowane.
- Organizatorzy nie biorą prawnej odpowiedzialności za przesłane prace oraz zastrzegają sobie prawo natychmiastowej dyskwalifikacji fotografii w przypadku podejrzenia naruszenia Regulaminu.
- W sprawach nieuregulowanych niniejszym Regulaminem zastosowanie znajdą odpowiednie przepisy prawa polskiego.
- Organizatorzy nie roszczą sobie przeniesienia praw autorskich ani majątkowych do nadesłanych prac, pozostają one własnością intelektualną autorów.
- Uczestnikom Konkursu przysługuje prawo dostępu do treści swoich danych oraz ich poprawiania lub żądania ich usunięcia, w tym celu powinni skontaktować się z Organizatorem, który jest administratorem danych. Podanie danych (które w przypadku braku wyrażenia ww. zgód będą przetwarzane w celu wykonania ww. obowiązków związanych z Konkursem oraz rozpatrywania reklamacji Uczestników Konkursu) jest dobrowolne, lecz niezbędne dla wzięcia udziału w Konkursie.
- Regulamin Konkursu wchodzi w życie 1 sierpnia 2020 r.
- Interpretacja zasad niniejszego Regulaminu należy wyłącznie do Organizatorów.
Competition Terms and Conditions: “This is what I like about Szczecin… upload three of your photographs with the city’s art that you like the most”
General provisions
- The online gallery SalonSztuki.net Jolanta Gramczyńska hereinafter referred to as the “Organiser” is the organiser of the competition called “This is what I like about Szczecin…upload three of your photographs with the city’s art that you like the most”, hereinafter referred to as the “Competition”.
- The competition concerns photographs taken in the Municipality of Szczecin showing places, objects with artistic features, i.e. having an aesthetic value, which the Participant will find particularly interesting and characteristic for this city.
- Competition is conducted based on these terms and conditions.
- The Competition starts on 1 August 2020 and runs until 13 September 2020.
- Participation in the competition is free and voluntary.
- The Organizer reserves the right to change the provisions of these Terms and Conditions in case of changes in the applicable legal regulations or for any other reason concerning the Competition schedule.
- The Competition is organised on the territory of the Republic of Poland.
Participants of the Competition
- Only those adults may be the participants of the Competition (excluding professionals and persons professionally involved in photography), who, by the date mentioned above, on their Facebook social network profile,sztukawszczecinie.pl in a post specially created for this purpose, will place photographs presenting a place in the Municipality of Szczecin, which the Participant particularly likes. The characteristics of this place should meet the requirements of the Competition.
- Employees or persons under the contract of mandate or any other legal relationship to which the provisions on order with the Competition Organiser apply cannot take part in the Competition as Participants.
- The Organiser is the controller of personal data of the Participants of the Competition. Personal data provided to the Organizer by the Participants of the Competition will be processed for the purpose of the Competition. Personal data may also be processed when it is necessary to fulfil the legitimate purposes of the controller. The provision of personal data is voluntary, but failure to provide it will prevent the winners from receiving the prizes.
Rules governing the participation in the Competition
- Only photographs taken by the Participant of the Competition, unpublished anywhere before, may be submitted. Works created jointly (co-authorship) are excluded.
- Each participant can submit a maximum of 3 photographs.
- To take part in the competition, one must like the www.sztukawszczecinie.pl profile on Facebook.
- Photographs should be sent in electronic form by posting (pasting) them as a comment in a post specially created for the purposes of the competition sztukawszczecinie.pl on the Facebook social networking site.
- Photographs must be sent between 1 August 2020 and 30 September 2020. Photos submitted after the specified deadline will not be admitted to the Competition.
- The photographs submitted should be described according to the following formula: Name_Surname_Title-photos and a short (up to three sentences) justification of choice.
- The Organiser allows for any format and size of the submitted photographs. Still, if the quality of the photographs is poor or if the format in which the photograph is recorded cannot be read, the photo will not take part in the Competition.
- It is not allowed to use photo-montage, which consists of combining elements of an image from different files.
- The submitted photographs will be commented on and evaluated by Facebook users.
- The Organizer reserves the right to disqualify works that do not meet the above requirements.
- If there is an image of a person in the photographs submitted in the competition, a participant sending the photograph is obliged to attach a written statement made by the person in the photograph that he or she agreed to the free publication and dissemination of the image of that person.
- By submitting a photograph in accordance with the contents of paragraph 5 above, each participant of the Competition grants a non-exclusive, free of charge license to use the photograph in the fields of exploitation listed in art. 50 of the Act of 4 February 1994 on Copyright and Related Rights to conduct and resolve the Competition and in the scope resulting from the content of these terms and conditions.
Jury
- The Organiser appoints a three-person Competition Jury, hereinafter in the terms and conditions referred to as the “Jury”.
- All photographs submitted to the Competition are subject to the Jury’s assessment.
- Decisions made by the Jury are final and legally binding for all participants in the Competition.
Awards
- The Organiser has provided for the following prizes awarded by the Jury:
- the main prize for the winner of the Competition: the cruise for two people by the Unity Line “Polonia” ferry on the Swinoujście-Ystad route and back,
- five I degree distinctions: a black and white photogram (60 cm x 80 cm) showing one of Szczecin’s Polish Steamship Company ships by Marek Czasnojć.
- ten II degree distinctions: Marek Czasnojć’s latest album “Szczecin Metamorphoses” from 2020 presenting 75 years of history of Polish Szczecin.
- The organiser also provided for the “audience” award, which is granted solely based on the accumulated number of likes on the sztukawszczecinie.pl Facebook social network profile, namely Marek Czasnojć’s latest album “Szczecin Metamorphoses” from 2020 presenting 75 years of the history of Polish Szczecin and his black and white photogram (60 cm x 80 cm) showing Szczecin’s Polish Steamship Company ships.
- Prizes in the competition are not exchangeable for cash.
- The Jury reserves the right to divide the prizes differently and not to award a prize in a given category, as well as to award additional prizes to the Participants of the Competition.
- The Organiser of the competition reserves the right to publish names and surnames of winners of the competition and to place this information in the organiser’s advertising materials and the press, media and the Internet.
- The winners of the Competition will be notified of how to receive the prize by e-mail by the date of 24 October 2020.
- After the competition, the winners are required to sign a report on the receipt of the non-cash prize. Prizes not collected till 30 October, 2020. shall be forfeited and become the property of the Organizer.
Final provisions
- The terms and conditions of this Competition are available at the Organizer’s seat and on the website: sztukawszczecinie.pl.
- By submitting the photographs, the Participant of the Competition declares that: a) he is the author of the attached photographs; b) he has exclusive and unlimited copyrights to the submitted photographs, which, as photographic works, are free of any legal defects and are not encumbered with the rights and claims of third parties; c) he agrees to publish the photographs on the website www.sztukawszczecinie.pl and the Facebook social networking site on his profile www.sztukawszczecinie.pl during and after the Competition.
- Persons who fail to meet any of the requirements of these Terms and Conditions or provide false information will be automatically disqualified.
- The Organizers do not take legal responsibility for the submitted works and reserve the right to immediately disqualify the photographs in case of suspected violation of the Terms and Conditions.
- In matters not regulated by these Terms and Conditions, the relevant provisions of Polish law shall apply.
- The Organizers do not claim the transfer of copyrights or economic rights to the submitted works; they remain the intellectual property of the authors.
- The Participants of the Competition have the right to access their data and to correct them or request their deletion; for this purpose, they should contact the Organizer, who is the data controller. Providing the data (which, in the absence of approvals mentioned above, will be processed to perform duties mentioned above related to the Competition and to consider the complaints of the Participants of the Competition) is voluntary, but necessary for taking part in the Competition.
- The Terms and Conditions of the Competition enter into force on 1 August 2020.
- The interpretation of the rules of these Terms and Conditions belongs exclusively to the Organisers.
